Efada Inbox by Efada Advertising and Marketing Company

Terms of Use

Version 1.0 · Last updated: 18 October 2026 · Applies to the Efada Inbox mobile app (Android package ai.efada.whatsapp; iOS app.efada)

These Terms of Use (“Terms”) are an agreement between you and EFADA ADVERTISING AND MARKETING COMPANY (“Efada”, “we”, “us”) governing your use of the Efada Inbox application and its related services (together, “the app” or “the service”). Efada Inbox is a shared team inbox that lets a business answer its customers on its own WhatsApp Business number. By creating an account, signing in, or using the app, you accept these Terms. If you do not agree, do not use the app.

1. Who may use the app

Efada Inbox is a business tool intended for use by adults (18+). You may use it only as an authorized agent or administrator of a business (the “Organization”) that operates a WhatsApp Business number and has been granted access by Efada. You are responsible for making sure your use complies with the Organization’s own policies and with applicable law.

2. Your account

3. Acceptable use

You agree not to use the app to:

4. Customer conversations and your responsibilities

The Organization is the controller of the customer conversations handled in the app; Efada provides the software and processes that data on the Organization’s behalf. You and your Organization are responsible for obtaining any consent required to message customers, for the content you send, and for handling customer data lawfully. Our Privacy Policy explains what the app accesses and why, and forms part of these Terms.

5. Third-party platforms

Messages and media are delivered through Meta’s WhatsApp Business Platform via our messaging provider, Interakt, and push notifications are delivered through Google (Firebase Cloud Messaging). Your use of those features is also subject to the applicable terms of Meta/WhatsApp, Interakt and Google. We are not responsible for the acts, omissions, availability or policies of these third parties.

6. Intellectual property

The app, its software, design and content (excluding your Organization’s own data and messages) are owned by Efada or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the app for your Organization’s internal business purposes, subject to these Terms. You may not copy, modify, distribute, sell or create derivative works from the app except as permitted by law.

7. Service availability and changes

We work to keep the service reliable, but we provide it on an “as available” basis and may change, suspend or discontinue features, or perform maintenance, from time to time. We may also update the app and require you to install the latest version to keep using it.

8. Disclaimers

To the maximum extent permitted by law, the app is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, or that messages will always be delivered by third-party platforms.

9. Limitation of liability

To the maximum extent permitted by law, Efada will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business, arising out of or in connection with your use of (or inability to use) the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Suspension and termination

Your access depends on the Organization’s continued use of the service and on your compliance with these Terms. We or your Organization may suspend or terminate your access at any time, including for a breach of these Terms. You may stop using the app and delete your account at any time — see how to delete your account. On termination, the rights granted to you under these Terms end.

11. Governing law

These Terms are governed by the laws of the State of Kuwait, without regard to conflict-of-laws rules, and the competent courts of Kuwait will have jurisdiction, except where applicable law gives you a mandatory right to bring proceedings elsewhere.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected here with a new version number and “Last updated” date, and, where appropriate, you may be asked to accept the updated Terms in the app before continuing to use it. Your continued use after an update means you accept the revised Terms.
